Welcome to Classic Arcade Fishing!
HEMA technology Limited (hereinafter referred to as "MANIA WIN" ,"we", ¡°us¡±, or ¡±our¡±) hereby remind you to read and understand these Terms & Conditions (hereinafter referred to as "this Agreement"). This is a legal agreement between you and MANIA WIN which governs your use of Classic Arcade Fishing and its Services therein and any other related website or online offering whether accessed via a computer or a mobile device or through any other manner or means (hereinafter collectively referred to as the "Service"). For proper use of Classic Arcade Fishing and its Service, please read carefully and fully understand the terms and conditions herein before your use of Classic Arcade Fishing, especially the Disclaimers, Limitation of Liabilities, Privacy Policy, Usage Rules, Applicable Law, Dispute Resolution and other sections which may have been highlighted in bold or in capital letters for your attention.
• Acceptance of this Agreement
• By downloading, installing, clicking on the ¡°register¡± or ¡°agree¡± button and/or accessing or using the Classic Arcade Fishing and its Service, you agree to comply with and be bound by this Agreement. If you do not agree to this Agreement, you may not access or use Classic Arcade Fishing and its Service.
• In order to improve your user experience or enhance product safety performance, we will continue to work hard to develop new features, and provide you in a timely manner with software updates (including but not limited to software version upgrades, modifications, and functional perfection) or repairs. Classic Arcade Fishing may reserve the right to modify this Agreement as necessary in accordance with applicable laws and regulations. The updated Agreement will shall supersede the original Agreement and shall come into effect after the expiration of the period stipulated by applicable law. If there is no special provision in applicable laws, the Agreement shall become effective on the date of renewal. The updated Agreement will be announced on the corresponding official website of Classic Arcade Fishing Service for your reference at any time. If you continue to access or use the Classic Arcade Fishing and its Service, you will be deemed as you having read and agreed to be bound by the updated Agreement. If you do not accept the updated Agreement, please stop using Classic Arcade Fishing Software or Service.
• Eligibility
• You must be at least 18 years of age (or the age considered as an "adult" in the jurisdiction where you use our service) to create an account on MANIA WIN and use the Service. If you are under the age of 18, you are not allowed to use Classic Arcade Fishing and its Service or provide Classic Arcade Fishing with any personally identifiable information.
• By creating a Classic Arcade Fishing account and using the Service, you represent and warrant that : (1) you can legally enter into a binding contract under the laws of your home country; (2) you are legally permitted to use Classic Arcade Fishing by the laws of your home country; (3) you will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations.
• Your Classic Arcade Fishing Account
• To access or use some of our Services, you must create an account with us. You can create a Classic Arcade Fishing account by providing your registration manually, or by using your social media account (such as Facebook, Google, Apple ID or Twitter) and password login details. Please use a social media account that is not yet tied to your Classic Arcade Fishing account and has not been blocked by Classic Arcade Fishing under this Agreement to register your Classic Arcade Fishing account. If you choose to use your social media account for login, you authorize us to access, display and use certain information from your social media account (such as your profile pictures, relationship status, location and information about your social media account friends). It is important to noted that, you must provide accurate and up-to-date information while you create your account. For more information regarding the information we collect from you and how we use it, please check out our Privacy Policy .
• You fully understand and agree that, if you register an account when using Classic Arcade Fishing, you will be responsible for keeping the security of the registered account information and account password properly, and you will be solely responsible for all activities and acts that occur under the account you registered with the Classic Arcade Fishing, including any contents that you publish and any consequences arising therefrom.
• You are NOT ALLOWED to use another person's account or to share your account with any other person without permission. If you think someone has gained access to your account, please immediately contact us.
• If Classic Arcade Fishing finds or receives a report from others that you have failed to comply with any of terms of this Agreement, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Services or infringe or violate any third party rights, or violate any applicable laws or regulations, Classic Arcade Fishing shall have the right at any time without notice to disable your user account at any time, to delete and shield relevant content, to suspend or terminate your use of the corresponding MANIA WIN account or all of the Service and to investigate legal responsibility and take other measures.
• You are able to delete your Classic Arcade Fishing account if you would like to stop using our service. You can delete your account by going to the ¡®Settings' page, and you can also contact us via MANIA WINyfun@gmail.com , we will provide you with further assistance. Once you choose to delete your account, you will not be able to reactivate your account or retrieve any of the content or information you have added.
• Permitted License Uses
Subject to the terms and conditions of this Agreement, Classic Arcade Fishing grants you a non-exclusive, non-sublicensable, personal, revocable, limited license to access and use Classic Arcade Fishing and its Service. You may install, use, display, and run Classic Arcade Fishing on your terminal device for non-commercial purposes.
• Usage Rules About Contents Published on Classic Arcade Fishing
• You are welcome and are permitted to upload, post or transmit (such as via a stream) or otherwise make available content through Classic Arcade Fishing Services including, without limitation, any text, photographs, user videos, and sound recordings. However, you shall be responsible and liable for your content and will indemnify, defend, release, and hold us harmless from any claims made in connection with your content. The content listed below is not allowed to upload, post or transmit or otherwise make available through your use of MANIA WIN:
• is obscene, pornographic, nude, sexually explicit, violent or otherwise may offend human dignity;
• contains language or imagery which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person (you are not allowed to engage, or encourage others to engage, in any targeted abuse or harassment against any other user. This includes sending any unsolicited sexual content to your matches);
• is abusive, insulting or threatening, discriminatory or which promotes or encourages racism, sexism, and hatred (any content that promotes, advocates for, or condones racism, bigotry, hatred, or violence against individuals or groups based on factors like (but not limited to) race, ethnicity, religious affiliation, disability, gender, age, national origin, sexual orientation, or gender identity is not allowed);
• encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offence;
• Content that advocates for or glorifies suicide or self-harm is also not allowed.
• is defamatory or libelous;
• relates to commercial activities (including, without limitation, sales, competitions and advertising, links to other websites or premium line telephone numbers);
• involves the transmission of ¡°junk¡± or ¡°spam¡± message;
• uses technical means to create fake accounts in batches;
• contains any spyware, adware, viruses, corrupt files, worm programs or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Bumble or otherwise;
• itself, or the posting of which, infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights);
• is harmful to minors (you must be 18 years of age or older to use Classic Arcade Fishing, and if you want to post photos of your children, please make sure that you are accompanied with your children and in the photo as well;
• is for soliciting other users (we may delete your account and content if the purpose of your profile is to advertise your event or business, non-profit, political campaign, contest, or to conduct research).
• If you do not wish to receive any further messages from any particular user, you may black out that user. To do so, you could click on "More" in the top right corner of the user's profile and select "Blackout". And if you find that any user has violated the above rules, you can click on "Report" in the chat with that user to submit your report. And you can also content our customer service and we will help you to settle down the issue at our earliest convenient time.
• You may not display any personal contact or banking information on your individual profile page whether in relation to you or any other person (for example, names, home addresses or postcodes, telephone numbers, email addresses, URLs, credit/debit card or other banking details). If you do choose to reveal any personal information about yourself to other users, whether via email or otherwise, it is at your own risk.
• You cannot post, display and show any contents that is copyrighted or trademarked by others, unless you are allowed to do so.
• You agree that your content may be viewed by other users of Classic Arcade Fishing all around the world, and any person visiting, participating in or who receive a link to a user's profile or shared content from other Classic Arcade Fishing users . By uploading your content on Classic Arcade Fishing, you represent and warrant to us that you have all necessary rights and licences to do so, and automatically grant us a non-exclusive, royalty free, perpetual, worldwide licence to use Your Content in any way (including, without limitation, editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, incorporating into other works, advertising, distributing and otherwise making available to the general public such Content, whether in whole or in part and in any format or medium currently known or developed in the future). We may assign and/or sub-license the above licence to our affiliates and successors without any further approval by you.
• Intellectual Property; Ownership
Classic Arcade Fishing reserves the intellectual property rights to this Software and Service and all related information content (including but not limited to UI interface design, pictures, fonts, audio, etc.) and all rights not expressly granted to you. The above intellectual property rights, including but not limited to copyright, trademark and patent rights, are protected by applicable intellectual property rights, anti-unfair competition and other respective laws, regulations and relevant international treaties. For matters not expressly authorized in this Agreement, such as commercial sales, reproduction, and permission for any third party to use Classic Arcade Fishing, you should separately obtain formal written permission from Classic Arcade Fishing.
• Restrictions on Classic Arcade Fishing App
• You shall not take any of the following actions when using this Software and Service, including but not limited to:
• Releasing, transmitting, spreading or storing contents which violate laws and regulations, policies, public order and good custom, and social ethics, such as insults, defamation, violence, or violation of religion, etc; releasing, transmitting, spreading or storing fabricated information or advertising information for the purpose of misleading or deceiving others;
• Jailbreaking, reverse engineering, disassembling, decompiling, or otherwise attempting to destroy this Software; or, accessing or disturbing this Software by the use of plug-ins, or third-party tools/services that are not authorized by Classic Arcade Fishing;
• Copying, modifying, adding, deleting, operating in the form of mounting, or creating any derivative works of data of the Software, data released into any terminal memory in the course of the operation of the Software, interactive data of the client and server side in the course of the operation of the Software, and system data necessary for the operation of the Software; or adding, deleting or changing the functions or operative effect of software by modifying or fabricating the instructions and data that occur in the course of the operation of the software; or operating or publicly diffusing the software and method used for the above purposes, whether commercially or otherwise;
• Carrying out other acts which violate laws and regulations, policies, public order and good custom, and social ethics or acts which are not authorized by Classic Arcade Fishing in writing.
• You may not, and you agree not to or enable others to, copy (except as expressly permitted by this Agreement), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, or create derivative works of the Software or any services provided by Classic Arcade Fishing or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or by licensing terms governing the use of open-source components that may be included with Classic Arcade Fishing). You agree not to remove, obscure, or alter any proprietary notices (including trademark and copyright notices) that may be affixed to or contained within Classic Arcade Fishing.
• Advertising and Promotional Service
• Classic Arcade Fishing has the right to display all kinds of information to you in the process of providing this Service, including but not limited to prompts for authorization, advertising information and promotional information, etc. The information may appear in the form of system messages or pop-up windows. If you do not agree to receive certain information, you can cancel the relevant service, which may eventually lead to unavailability of the relevant service function.
• You shall be solely responsible for transactions conducted by the advertising information you received, except as expressly provided by applicable law. MANIA WIN shall not be liable for any your loss or damage as a result of the transactions carried out by the advertising information or the content provided by the advertiser.
• Fees and Virtual Items, Advertisement
• Classic Arcade Fishing offer both free service and paid services. For the Classic Arcade Fishing free service, you understand and agree that although some features of Classic Arcade Fishing and its Service are currently offered to you free of charge, however, along with the continuous renewal of our Service, you may need to pay for some part of Classic Arcade Fishing or Service provided by Classic Arcade Fishing. Classic Arcade Fishing reserves the right to add fee-charging features and functionalities in future Service.
• For the Classic Arcade Fishing paid service (In-App Purchase ), we will clearly notify you before your use and you may choose whether to accept or use such paid features or service. At that time, please use such paid service according to our instructions (including but not limited to service fee standards, payment terms and service rules). If you choose to use such paid services, you acknowledge and agree that additional terms, disclosed to you at the point of purchase, may apply, and that such additional terms are incorporated herein by reference.
• You may make an In-App Purchase through the following payment methods (¡°Payment Method¡±): Making a purchase through a third-party platform which includes Apple App Store and Google Play Store (¡°Third Party Store¡±);
Please note that once you have made an In-App Purchase, you authorize us to charge your chosen Payment Method.
• You may be able to purchase or earn a limited, personal, non-transferable, non-sublicensable, revocable license to use "virtual items", which could include virtual products or virtual ¡°coins¡± or other units that are exchangeable within the Service for virtual products (collectively, "Virtual Items"). Virtual Item is not a property good such as balances or advances. Any Virtual Item balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license. Classic Arcade Fishing shall have no liability to you or any third party in the event that Classic Arcade Fishing exercises any such rights. Virtual Items may only be redeemed through the Service. The provision of Virtual Items for use in the Service is a service that commences immediately upon the acceptance of your purchase of such Virtual Items. YOU ACKNOWLEDGE THAT Classic Arcade Fishing IS NOT REQUIRED TO PROVIDE A REFUND OR REVERSE EXCHANGE SERVICE IN RESPECT OF VIRTUAL ITEMS FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.
• Classic Arcade Fishing, in its sole discretion, reserves the right to charge fees for the right to access or use Virtual Items and/or may distribute Virtual Items with or without charge. Classic Arcade Fishing may manage, regulate, control, modify, or eliminate Virtual Items at any time. You shall not sell, redeem, or otherwise transfer Virtual Items to any person or entity.
• Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. We may make an exception if the laws applicable in your jurisdiction provide for refunds.
• Your use of this Software and Service will consume your device, bandwidth, traffic and other resources. Fees for the above resources such as purchasing a Classic Arcade Fishing device, Internet access fees, SMS fees, and payment for the Software's value-added services shall be borne by yourself.
• Privacy Policy
When you are using Classic Arcade Fishing Device, Software and Services, Classic Arcade Fishing may need to collect personal data to provide you the Services. Classic Arcade Fishing pays great attention to the protection of your personal data and has made the Classic Arcade Fishing Privacy Policy, which states the detailed information of the way Classic Arcade Fishing collects, uses, stores, transfers, and discloses your personal data. You may refer to the details of the "Privacy Policy" at ¡°Settings¡± - ¡°Agreement¡± , which forms an integral part of this Agreement . By downloading, installing or using the Services, you agree to be bound by the terms of this Agreement and its Privacy Policy, and Classic Arcade Fishing will protect your privacy in accordance with this Privacy Policy.
• Updates of this Agreement
In order to better provide you with relevant Service and to guarantee the security of Classic Arcade Fishing, we may update Classic Arcade Fishing and relevant Services from time to time (including but not limited to software modification, software upgrades, partial function disabling, function strengthen, new service development, software replacement and function improvement). You may choose whether to upgrade to the corresponding version based on your needs. In order to facilitate your experience of a better service by the Classic Arcade Fishing device, and in compliance with applicable laws, Classic Arcade Fishing may enable automatic upgrade and update function for you by default. You can choose whether to enable this function in software settings. In case of such updates, we will notify you in an appropriate manner (including but not limited to system notifications, site messages, announcements, application store update notifications, etc.), and you have the right to choose whether to accept the updated version.
• Software and Services Provided by Third Parties
• In order to facilitate your use of the Classic Arcade Fishing device, this Software or this Service may use third-party software or services, and the results of such use and access are provided by the third party (including but not limited to the services and contents provided by the third party that you jump to through this Software, this Service, or accessed by said third party through Classic Arcade Fishing's open platform). In addition to the terms of this Agreement, you shall comply with the user agreements of third parties in using software or services provided by third parties on the Classic Arcade Fishing device. Classic Arcade Fishing cannot guarantee the security, accuracy and validity of the services and contents provided by third parties and other uncertain risks, and you shall solely bear relevant risks and responsibilities arising therefrom.
• Whether the third-party software or services are pre-installed in the Classic Arcade Fishing device or activated or subscribed by yourself, you understand and agree that Classic Arcade Fishing disclaims all express or implied warranties with respect to the security, accuracy and validity of the services and contents provided by third parties and other uncertain risks.
• Any dispute between you and the above third-party software and services providers shall be settled by you and such third party with you taking relevant responsibilities, if any.
• Termination and Breach of Contract
Classic Arcade Fishing has the right to judge whether your behavior complies with the terms of this Agreement. If you are deemed to have violated relevant laws and regulations or fail to comply with any terms and conditions of this Agreement or related rules, based on the severity of your violation, Classic Arcade Fishing and its licensors shall have the right to delete the content in violation, to limit, to suspend or to terminate your use of Classic Arcade Fishing Software and Service without notice, and to take other measures that Classic Arcade Fishing considers appropriate. And you will be held liable for your incompliance behavior. Once it is terminated, you must stop using Classic Arcade Fishing and its Service.
You will indemnify, release and hold harmless Classic Arcade Fishing, its parent, subsidiaries and affiliates, and all officers, directors, agents and employees thereof, and any party acting on Classic Arcade Fishing's behalf, from and against any and all third party claims, actions, liabilities, losses, damages, judgments, costs and expenses, including reasonable attorneys' fees (collectively, "Claims") arising out of (i) any use of the Classic Arcade Fishing Services or products appearing on the MANIA WIN Services by you or by any person that is not in accordance with the terms of this Agreement; (ii) any breach of this Agreement by you or by any person that you allow to use the Classic Arcade Fishing Services; or (iii) any violation of any laws, regulations or the rights of any third party by you or by any person that you allow to use the Classic Arcade Fishing Services or products appearing on the Classic Arcade Fishing Services.
• DISCLAIMERS
• DISCLAIMER OF WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE Classic Arcade Fishing SOFTWARE AND SERVICES ARE PROVIDED ¡°AS IS¡± AND ¡°AS AVAILABLE¡± WITHOUT ANY WARRANTIES OR GUARANTEES OF ANY KIND OR NATURE, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY (IF ANY) IMPLIED WARRANTIES, DUTIES OR CONDITIONS OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, OF WORKMANLIKE EFFORT, OF LACK OF VIRUSES, AND OF LACK OF NEGLIGENCE, ALL WITH REGARD TO THIS SOFTWARE AND SERVICE.
• THIS SOFTWARE DOES NOT CONTAIN ANY MALICIOUS CODE DESIGNED TO DESTROY YOUR DEVICE DATA OR TO OBTAIN YOUR PRIVACY INFORMATION. Classic Arcade Fishing WILL ALSO DO ITS UTMOST TO ENSURE THE SAFE, PROMPT, EFFECTIVE, ACCURATE, RELIABLE AND CONTINUOUS OPERATION OF THIS SOFTWARE AND SERVICE, BUT WITH THE LIMITATION OF THE EXISTING TECHNOLOGY, THIS SOFTWARE AND RELATED SERVICE MAY BE AFFECTED BY VARIOUS UNSTABLE FACTORS, Classic Arcade Fishing MAKES NO WARRANTIES OR REPRESENTATIONS THAT THE SOFTWARE IS COMPATIBLE WITH ALL SOFTWARE AND HARDWARE SYSTEMS, OR IS ERROR-FREE, CAN OPERATE WITHOUT INTERRUPTION OR THAT ANY ERRORS IN THE SOFTWARE OR RELATED SERVICE CAN BE CORRECTED. IN CASE OF CIRCUMSTANCES SUCH AS INCOMPATIBILITY OR SOFTWARE MALFUNCTION, PLEASE CONTACT US FOR TECHNICAL SUPPORT. IF THE COMPATIBILITY PROBLEM CANNOT BE SOLVED, YOU CAN DELETE THIS SOFTWARE. WITHIN THE MAXIMUM SCOPE PERMITTED BY APPLICABLE LAWS, Classic Arcade Fishing IS EXEMPT FROM ANY OF YOUR LOSSES CAUSED HEREIN.
• LIMITATION OF LIABILITIES
TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT SHALL Classic Arcade Fishing, ITS AFFILIATES, SENIOR MANAGEMENT, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, BUSINESS INTERRUPTION OR ANY OTHER INTANGIBLE DAMAGES OR LOSSES, ARISING OUT OF THE FOLLOWING REASONS, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF Classic Arcade Fishing HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES: (i) YOUR USE OR INABILITY TO USE THE SERVICE;(ii) THE UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iii) THE DELETION OF, CORRUPTION OF, OR FAILURE TO USE YOUR TRANSMISSIONS OR DATA ON OR THROUGH THE SERVICE; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; AND (v) ANY OTHER MATTER RELATING TO THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
AT THE SAME TIME, Classic Arcade Fishing'S MAXIMUM COMPENSATION FOR ALL YOUR LOSSES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR USING/PURCHASING THE CORRESPONDING Classic Arcade Fishing DEVICE, SOFTWARE OR SERVICES (IF PAID SERVICE IS INVOLVED) WITHIN 12 MONTHS BEFORE THE DATE OF INITIATING THE CLAIM. IF THE LAW OF YOUR REGION DOES NOT ALLOW THE LIMITATION OF LIABILITY THROUGH AN AGREEMENT. IN THIS CASE, THE APPLICABLE LAWS AND REGULATIONS SHALL APPLY.
• Governing Laws and Dispute Resolution
• Governing Laws. The execution, performance, interpretation, modification and disputes settlement of this Agreement shall be governed by the laws of Hong Kong, excluding its conflict-of-law provisions. You agree that this Agreement is signed in Hong Kong.
• Arbitration. Any dispute or controversy between you and Classic Arcade Fishing based on this Agreement shall be first settled through friendly negotiation. If no settlement can be reached through friendly negotiation, you unconditionally consent and agree that any claim, dispute or controversy (whether in contract, tort or otherwise) you may have against any Classic Arcade Fishing entity, the directors, agents, and employees of any Classic Arcade Fishing entity arising out of, relating to, or connected in any way with Classic Arcade Fishing Services, shall be submitted to Hong Kong International Arbitration Center (HKIAC) for settlement before one (1) arbitrator in accordance with the rules of HKIAC. The arbitration shall take place in Hong Kong, and the arbitration proceedings and all pleadings and written evidence shall be in the English language, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. You will only be permitted to pursue claims against Classic Arcade Fishing on an individual basis, not as a plaintiff or class member in any class or representative action or proceeding.
• Heading. The headings of all terms of this Agreement are for reference purpose only, have no actual meanings themselves, and shall not be used as a basis for interpreting the meanings of this Agreement.
• Severability. If any term or provision of this Agreement is held to be invalid or unenforceable by any judicial or administrative authority for any reasons, such determination shall not affect the validity of enforceability of the remaining terms and provisions of the Agreement hereof, and the remaining provisions of this Agreement shall remain in full effect and shall be construed in accordance with its terms.
• Languages. If this Agreement is made in English and other languages. In case of any discrepancy, the English version hereof shall prevail.
• No Waiver. The failure of Classic Arcade Fishing to enforce at any time any of the provisions of the Classic Arcade Fishing Services, or the failure by Classic Arcade Fishing to require at any time performance by you of any of the provisions of the Classic Arcade Fishing Services, shall in no way be construed to be a present or future waiver of such provisions, nor in any way affect the right of Classic Arcade Fishing to enforce such provision thereafter. The express waiver by Classic Arcade Fishing of any provision, condition or requirement of the Classic Arcade Fishing Services shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.
• Entire Agreement. This Agreement constitutes the entire agreement between you and Classic Arcade Fishing governing your use of the Software and supersedes any prior agreements between you and Classic Arcade Fishing relating to the use of the Software. You may also be subject to additional terms and conditions that may apply when you use or purchase open-source software, third-party content, or other Classic Arcade Fishing services.
